Christmas Promotion Box Terms and Conditions

1 THE PROMOTOR 

1.1 The Milwaukee® Christmas promo competition 2024 ("Promotion") is promoted by Techtronic Industries Central Europe GmbH, whose registered address is 22 Market Street, Maidenhead, SL6 8AD ("Promoter").

1. 1.2 Participation into the Promotion is deemed acceptance of this Agreement. Participants will be subject to the terms of use of the Milwaukee® website found here https://www.milwaukeetool.eu/footer/terms-of-use/ and the participant’s personal data will be processed in accordance with the Promoter's privacy policy available at www.milwaukeetool.eu/footer/privacy-policy/.

2. 1. 2 ELEGIBILITY

   2. 2.1 This Promotion is open to any resident of United Kingdom, Netherlands, France, Switzerland, Austria, Germany, Denmark, Finland, Norway, Sweden, Spain or Portugal over the age of 18 years at the date of entry.
   3. 2.2 Employees, officers and directors of Techtronic Industries Central Europe GmbH and its affiliated companies or their family members or anyone else connected in any way with the Promotion or helping to set up the Promotion shall not be permitted to enter the Promotion, any such entries will be deemed as void.
   4. 2.3 Participants are responsible for ensuring that they are entitled to participate and proof of eligibility may be required and prizes withheld until Promoter is fully satisfied the above criteria are met.
   5. 2.4 There is no entry fee and no purchase necessary to enter this Promotion; although internet connection and mobile data rates may apply to the participant. The cost of access to the Promotion website will depend on and shall be the sole responsibility of the participant’s internet service provider. The Promoter is not responsible for the participant's costs.
   6. 2.5 By entering this Promotion, a participant indicates that he accepts and agrees to these conditions.

3 HOW TO PARTICIPATE

1. 3.1 The Promotion begins at 00:01 on 1st October 2024 and ends at 11:59pm on 12th November 2024 (the “Promotion Period”).
2. 3.2 To participate in the draw, participants can subscribe to the Milwaukee Heavy Duty News™  via the pop-up form which will be displayed to users after thirty (30) seconds of activity on the website. For the avoidance of doubt, individuals may join the mailing list and subscribe the newsletter without being a part of the Promotion through the following link www.milwaukeetool.eu.

3.3 To subscribe to the Milwaukee Heavy Duty News™:

i. All participants must enter their email address and accept the T&C's and the privacy policy of the Promotion by populating their information within the pop-up form ("Pop-up Form”).

ii. All participants will then receive a confirmation link to the email address provided via the pop-up form. Participants may need to confirm their email address before they can participate in the Promotion.

3.4 A prize will be awarded to sixty (60) winners chosen at random at the end of the Promotion Period (see Annex 1).

3.5 The winners of the draw will receive the prizes indicated in Annex 1.

3.6 The winners will be randomly selected from all correct entries on 15th November, 2024.

3.7 Mass registrations made by the merchant, consumer groups, trade unions or the like will not be accepted. Cheating of any kind will not be accepted, including the use of macros or other automated means of participation, identity masking by manipulating IP addresses, using any false identity or any other behavior that falls outside the spirit of the promotion (to be determined in our absolute discretion). Any participant who cheats will be excluded.

3.8 Participants that attempt to submit multiple entries by unsubscribing and resubscribing to the newsletter via the pop-up will not be accepted.

3.9 The Promoter accepts no liability for entries that have not been received, deleted, altered or invalid, for any reason not attributable to it.

4 PRIZES AND WINNERS ANNOUNCEMENT

4.1 The winners will be chosen at random by computer-generated selection by the Promoter from all valid and correct entries from 1st October 2024 to 12th November 2024. The winners will be announced no later than 15th November 2024. The prize will be delivered within thirty (30) working days from the date the winner provides their postal address to the Promoter.

4.2 The winner will be notified by email where the Promoter will request the delivery address for the shipment the prize. If a winner cannot be contacted or does not claim the prize within fourteen (14) days of notification, the Promoter reserves the right to withdraw the prize from the winner and select a substitute winner. The Promoter shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.

4.3 Promoter is not responsible for inaccurate prize details supplied to any participant by any third party connected with this Promotion and no cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of similar characteristics and value without giving notice.

4.4 The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.

5 DATA PROTECTION

1. 5.1 Personal data relating to the participants will be used for the purposes of this Promotion in accordance with the current GDPR legislation and the Promoter’s Privacy Policy found at https://www.milwaukeetool.eu/footer/privacy-policy/. The Promoter reserves the right to contact all participants to verify their personal data. For the avoidance of doubt, any entry made in relation to the Promotion as set out at Clause 3 will be deemed to have given consent for the Promotor to process all personal data as defined under Art.4 (1) General Data Protection Regulation 2016/ 679.

6 GENERAL

1. 6.1 Promoter reserves the right to cancel or amend the Promotion and these terms and conditions without notice at any time. Any changes to the Promotion will be notified to participants as soon as possible by Promoter. 
2. 6.2 The Promotion and these terms and conditions will be governed by the law of the Federal Republic of Germany applies exclusively and any disputes will be subject to the exclusive jurisdiction of the courts of Germany.
3. 6.3 If any provision of these terms and conditions are held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
4. 6.4 Insofar as is permitted by law, the Promoter, its agents or affiliates will not in any circumstances be responsible or liable to compensate the recipient or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the decal sticker except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
